Culture is changing quickly when it comes to perceptions about Marijuana use. You may feel brave knowing Marijuana is legal in Illinois. If your curiosity for Cannabis or use of Cannabis gets ruined by a run-in with law enforcement Scott has some important information you may need if you ever find yourself in a tight spot.
Effective January 2020 it became legal in Illinois to possess recreational Marijuana with certain limitations. As a resident of Illinois, or if you are visiting the state, it is important to know the rules so that you can avoid being arrested, fined, or worse, face jail time for possession.
I CAN BE IN POSSESSION OF MARIJUANA, RIGHT?
Not just anyone can walk around with a pocket full of Marijuana in Illinois. The law prohibits anyone under the age of 21 to be in possession of Marijuana and adult residents of Illinois are limited to possessing up to 30 grams of Cannabis (cut that in half if you are a resident of another state). The law also indicates that you cannot use Cannabis in public, or drive a car while under the influence of Marijuana. You also cannot use Cannabis around minors or while working, if your employer has banned the use of Marijuana by their employees. Lastly, if you are transporting Cannabis, it must be in the original sealed packaging.
WHAT IF I RUN INTO POLICE WHILE I AM HIGH OR HAVE MARIJUANA ON ME?
There are certain factors that all individuals should keep in mind if they are detained by law enforcement. Scott’s first advice is to remain calm. Elevated emotions when encountered by the police rarely help your case should you be arrested. You can avoid a charge of resisting arrest or assaulting a police officer if you just stay calm.
SHOULD I TALK TO THE POLICE?
If you are placed under arrest it is usually in your best interest to avoid answering questions, other than identifying information like your name and address. You know the phrase from the Miranda warning, but it is literally true that anything you say, or any comment you make, can be used against you. Don’t make small talk with the police, don’t try to be cute or funny, and don’t sign anything or write anything down no matter what their questions are or how nice they may seem. Tell the police you are not answering any questions until your attorney is present.
